Welcome to Yaje, help our users to search and book travel experiences, however, when making a reservation, you will be buying a ride, a ticket or other service directly from a third-party vendor who is a Yaje Partner.

These Terms of Use apply to any use of Yaje's services. Please read these Terms of Use carefully, as they contain important information about your legal rights and limitations to those rights, as well as a section on applicable law and dispute jurisdiction. By accessing or using the Yaje services, you indicate that you have read these Terms of Use and agree to be bound by them. If you do not agree with all of these Terms of Use, you are not allowed to access or use our services.

1. Introduction

  1. 1.1

    These terms of use, together with the Privacy Policy (collectively, the "Terms of Use") set out the terms under which Yaje LTDA provides services through the platform. Yaje reservations that may be made available on our website (https://yaje.com.br, along with all related domains, white label and affiliate websites, mobile properties and related apps, collectively referred to as the "Site") and by phone. When we refer to "you", we refer to anyone who accesses or uses the Services. Yaje is not a tour or travel agency, nor is it a provider of tours, activities or experiences. When you make a reservation, you are using the Platform to contract third party providers.

  3. 1.3

    These Terms of Use govern your relationship with us in relation to your use of the Services, including any reservations you make for any tour, ticket, attraction, activity and/or experience (described in these Terms of Use as an "Experience") that is advertised on the Site and made available by a third-party provider.

  4. 1.4

    By using or accessing the Services, reserving a product and/or creating an account on the Website (a "Yaje Account"), you agree to be bound by these Terms of Use without modification, and you represent that you have read and understood them. In all booking arrangements, the person making the booking will be deemed to have accepted these Terms of Use on behalf of all persons named in the booking.

  5. 1.5

    We may update or otherwise modify these Terms of Use at any time, and you understand and agree that your continued access to or use of the Services after such change signifies your acceptance of the updated Terms of Use. We will show the date the last updates were made to the Terms of Use at the top of this page, and the updated Terms of Use will take effect upon posting. It is your responsibility to return to this page periodically to review the most current version of the Terms of Use.

2. Use of the Services

  1. 2.1

    As a condition of your use of the Services, you represent and warrant that:

    1. All information provided by you in the course of your use of the Services are true, accurate, current and complete; and
    2. You are 18 years of age or older to use the site.

    Yaje does not knowingly collect information from anyone under 18 years of age.

  2. 2.2

    You agree not to use these Services to make speculative, false or fraudulent reservations or requests.

  3. 2.3

    You further represent and warrant that:

    1. You are not currently suspended and have not previously been prohibited by Yaje from using the Services;
    2. Are not acting on behalf of a competitor of Yaje;
    3. You will not create more than one Yaje Account; and
    4. Have full powers and authority to enter into this legally binding agreement and, in doing so, will not violate any other agreement to which you are a party.
  4. 2.4

    We reserve the right, in our sole discretion, to deny access to the Services to anyone at any time and for any reason, including, but not limited to, for breach of these Terms of Use.

  5. 2.5

    By accessing or using the Site, you may be exposed to content that is offensive, indecent, inaccurate, objectionable or otherwise inappropriate. Yaje does not endorse such content and cannot guarantee its accuracy. Therefore, you access and use the website at your own risk and expense.

3. Yaje Accounts

  1. 3.1

    You may need to create a Yaje Account and provide information about yourself in order to use some of the features of the Site and other Services, including when you make a Reservation. You are responsible for maintaining the confidentiality of your Yaje Account password and login credentials ("Yaje Account Credentials"). You are also solely responsible for all activities (including bookings) that occur in connection with your Yaje Account. You agree to notify us immediately of any unauthorized use of your Yaje Account.

  2. 3.2

    Your Yaje Account is for personal use only. You may not impersonate anyone else (for example, adopt the identity of a celebrity), create a Yaje Account for anyone other than yourself, provide an email address or other personal data that is not your own, or create multiple Yaje accounts.

  3. 3.3

    We may terminate or suspend access to your Yaje Account or your ability to use the Services, in whole or in part, in our sole discretion, for any reason or no reason and without notice or liability of any kind. For example, we may terminate or suspend your Yaje Account or ability to use the Services if you misuse the Site. Any termination or suspension may prevent you from accessing your Yaje Account, the Site, User Content (as defined in Section 6.1), Site Content (as defined in Section 4.1) and/or any other related information.

  4. 3.4

    You may terminate your Yaje Account at any time by contacting us to request the termination of your Yaje Account and discontinuing your use of any and all parts of the Services. If you close your Yaje Account, we may continue to display your previously posted User Content and we are under no obligation to remove any portion of your User Content.

  5. 3.5

    AS A USER OF THE SERVICES, YOU UNDERSTAND AND AGREE THAT:

    1. NEITHER YAJE NOR ITS AFFILIATES SHALL HAVE ANY LIABILITY TO YOU OR OTHERS FOR ANY UNAUTHORIZED RESERVATIONS MADE USING YOUR YAJE ACCOUNT AND/OR YAJE ACCOUNT CREDENTIALS; AND
    2. UNAUTHORIZED USE OF YOUR YAJE ACCOUNT AND/OR YAJE ACCOUNT CREDENTIALS MAY BRING YOU INCURRING LIABILITY TO YAJE AND OTHER USERS.

4. Atividades proibidas no site

  1. 4.1

    The content and information on the Site (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software (including Software, as defined in Section 8.2), code or other material, and collectively described herein as the "Site Content"), as well as the infrastructure used to provide such Site Content, is our property. You agree not to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, sell or resell any Site Content, any products or services obtained from or through the Site on the Internet. Any other use of Site Content, products and/or services requires the prior written permission of Yaje.

  2. 4.2

    You further agree that you will not and will not assist or allow others to:

    1. Use the Website or Website Content for any commercial or illegal purpose;
    2. Access, monitor or copy any Content on the Site using any robot, spider, scraper or other automated means or any manual process to access, scrape, index, retrieve or otherwise use the website or any content on the website for any purpose without our express written permission;

    8. Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any Software;
    9. Use the Site to threaten, stalk, defraud, incite, harass or defend another person's harassment or otherwise interfere with another user's use of the Site;
    10. Use the Site to send or transmit spam, chain letters, contests, junk mail, pyramid schemes, surveys or other mass messages, whether commercial in nature or not;
    11. Use the Site in ways that could create a conflict of interest, such as negotiating reviews with other business owners or writing or soliciting reviews;
    12. Use the Site to promote intolerance or discrimination against protected classes;
    13. Use the Site to violate any third party right, including any breach of trust, copyright, trademark, patent, trade secret, moral right, right to privacy, right of publicity or any other intellectual property or proprietary right;
    14. Use the Site to send or transmit pornography or illegal content;
    15. Use the Site to solicit personal information from minors, or to harm or threaten to harm anyone, including minors;
    16. Attempting to gain unauthorized access to the website, user accounts, computer systems or networks connected to the website through hacking, password extraction or any other means;
    17. Use the Site to transmit computer viruses, worms, defects, Trojan horses or other items of a destructive nature (collectively, "Viruses");
    18. Use any device, software or routine that interferes with the proper functioning of the Site or otherwise attempts to interfere with the proper functioning of the Site;

5. Electronic Communications

  1. 5.1

    When you use the Yaje Site, or send emails, text messages and other communications from your desktop or mobile device to us, you are communicating with us electronically and you agree that we may communicate with you in various ways, such as by mail, in-app push notifications or by posting notifications and messages on the Site. You can unsubscribe from marketing-related emails by sending an email to unsubscribe@yaje.com.br; however, we may continue to send non-marketing messages, such as messages related to any future Bookings.

6. Content

  1. 6.1

    You and other users can contribute to the Site in a number of different ways, including sending emails, writing reviews, making posts, sending and posting photos or videos, making comments or suggestions, submitting ideas, filling out public profiles, rating contributions from other users and make other contributions or similar submissions to the Site and/or otherwise to Yaje (collectively, "User Content"). We may use User Content in a number of different ways, including but not limited to displaying it on the Site, formatting it, translating it into other languages, editing it for clarity and grammar, incorporating it into advertisements and others works by creating derivative works from it, promoting it, distributing it, and allowing others to do the same for their own websites, mobile properties, apps, and media platforms.

  2. 6.2

    By submitting User Content, you grant Yaje and its affiliates a worldwide, non-exclusive, royalty-free, fully paid, perpetual, transferable, irrevocable and fully sublicensable right to:

    1. Not require that any personally identifiable information be used in connection with User Content, or any derivative works or updates or updates to them;
    2. You have no objection to the publication, use, modification, deletion and exploitation of User Content by Yaje or its licensors, successors and assigns;
    3. You forever waive and agree not to claim or claim any rights to any and all moral rights of an author in any part of User Content; and
    4. You forever exempt Yaje, and its licensors, successors and assigns, from any claims You might otherwise make against Yaje by virtue of such moral rights.
  3. 6.3

    Yaje is not responsible and assumes no responsibility for any User Content posted, stored or uploaded by you or any third party, or for any loss or damage, nor is Yaje responsible for any errors, defamation, slander, omissions, falsehoods , obscenity, pornography or profanity you may encounter.

7. Links to third-party sites

  1. 7.1

    The Site may contain hyperlinks to sites operated by third parties other than Yaje ("Third Party Sites"). These hyperlinks are provided for your reference only. Their presence on the Site does not imply any endorsement by Yaje of the material on these Third Party Sites or any association with their operators.

  2. 7.2

    We do not control Third Party Sites and are not responsible for their content, or for the privacy or other practices of those who own and operate them.

  3. 7.3

    It is your responsibility to ensure that any hyperlinks you select and/or downloaded software are virus free.

  4. 7.4

    In some cases, you may be asked on a Third Party Site if you wish to link your Yaje profile to a profile on such Third Party Site. Choosing to do this is optional. If you decide to link your profiles and later wish to disable this link, you must contact the Third Party Site.

8. Software

  1. 8.1

    You acknowledge and agree that all Software contained on the Site is protected by copyright laws and international treaty provisions. Any reproduction or redistribution of the Software is expressly prohibited and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.

9. Products and booking schedules

  1. 9.1

    Yaje provides the Platform through which you can enter into an agreement with a third party supplier of a Product ("Supplier"). Yaje is not a supplier of any Product, and your contract to supply any Product that you reserve will be directly between you and the applicable Supplier.

  2. 9.2

    If you make a Booking, you agree to review and abide by the applicable Supplier terms and conditions and any other rules or policies relating to the Product (the "Supplier Terms"). Notwithstanding the foregoing, to the extent that the Supplier Terms conflict with these Terms of Use in relation to your legal relationship with Yaje, these Terms of Use will prevail. Your interactions with suppliers are at your own risk and expense. Yaje shall have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any Supplier or for any personal injury, death, property damage or other damages or expenses resulting from your interactions with any Supplier.

  3. 9.3

    Yaje is not a travel agency and does not provide or own any Experiences. Although Yaje provides product information to the site and facilitates reservations, such actions do not in any way constitute Yaje's sponsorship or approval of such suppliers, or any affiliation between Yaje and any Supplier. While Yaje members can evaluate specific products based on their own experience, Yaje does not endorse or recommend any product. You agree that Yaje is not responsible for the accuracy or completeness of information that it obtains from suppliers and/or that is displayed on the website.

  4. 9.4

    By making a reservation, you warrant that you are at least 18 years of age, that you have the legal authority to enter into this binding contract and a binding contract with the supplier, to use the services, to purchase the product, and that all information provided are true and accurate. You also agree that you will use the Platform to make only legitimate Reservations for you and/or others for which you are legally authorized to act.

10. Prices

  1. 10.1

    Price quotes are subject to change without prior notice, until the Reservation is made.

  2. 10.2

    Unless Provider has specified otherwise, prices do not include any local taxes or usage fees, including foreign embarkation, security, port fees, parking fees, customs, immigration, agriculture, passenger installation fees or fees of international transport.

  3. 10.3

    Inclusions are determined by the Supplier. Prices do not include:

    1. Tips/Gratuities;
    2. Passport and Visa Fees;
    3. Baggage and personal insurance;
    4. Any items of a personal nature;
    5. Taxes or fees; and
    6. Any beverages or foods that the Supplier has not specifically stated are included.

11. Payments

  1. 11.1

    When you make a Reservation, Yaje collects your payment information and processes your payment through a Payment Gateway. In so doing, Yaje acts as the Supplier's limited payment collection agent, collecting its payment for the applicable Product(s) on behalf of such supplier. Full payment by credit or debit card is required to make a reservation, unless otherwise specified. The beneficiary will be listed as Yaje on your statement.

  2. 11.2

    The value of your reservation may be subject to taxes, fees, foreign transactions, exchange or other fees. Your bank or payment card company may convert your payment to local currency and may charge fees, resulting in differences between the amount displayed through the Platform and the final amount charged to you. Yaje recommends that you contact your bank or card company if you have any questions about any currency conversions or applicable fees.

12. Modifications or cancellations made by you

  1. 12.1

    Once a Product has been purchased, your Reservation cannot be changed by you or canceled with a refund, unless otherwise stated in the terms and conditions applicable to such Product.

  2. 12.2

    The standard cancellation policy allows you to request a change and/or cancel a reservation up to 24 hours before the reservation start time; or if the Experience does not have an explicit start time, the deadline for requesting change or cancellation will generally be 11:59 pm, two days prior to the start date. Times are calculated according to the Experience time zone.

  3. 12.3

    If any product is designated as 'All Final Sales' or with materially similar messages (which include, but are not limited to, all group bookings made through our Group Booking Department), it is non-refundable and will not be possible to change or cancel after making a reservation. A minority of products have other, different cancellation policies. In all circumstances, you should check the cancellation policy contained in the applicable product list at the time of your booking, which is the policy that will apply and govern the terms of your cancellation and any refunds.

  4. 12.4

    If you make a reservation using a promotional code, or if you accept a discount or special offer price during the checkout process, you can void your discount or special offer price by submitting a change request after booking.

  5. 12.5

    No refunds are available once an Experience has begun, or in relation to any Product package, accommodation, meals or any other services that have started to be used.

13. Other Modifications and Cancellations

  1. 13.1

    From time to time, a Supplier may make a change to a Product after its purchase, including, but not limited to: date, price, inclusions, coverage, age requirements and/or any other features and/or Product requirements. As a result, Yaje (acting on behalf of the Supplier) reserves the right to cancel, change or replace any Product you have purchased at any time for any reason. If the Supplier's proposed change is material (for example, a change in dates and/or a significant change in itinerary), and you are not satisfied with the alternative that is offered, you will be entitled to a full refund of the original purchase price.

  2. 13.2

    We may decide, in our sole discretion, that it is necessary or desirable for the protection of our interests, the Supplier's interests and/or its interests, to withdraw our Services, resulting in a voiding of the Product's cancellation policy and the effective cancellation of a reservation. We may also determine, in our sole discretion, to arrange for a refund of part or all of the amounts charged to you. You agree that we and the applicable Supplier shall have no liability for such cancellations or refunds.

14. Passports, Visas and Insurance

  1. 14.1

    When making a Reservation, you are responsible for ensuring that you comply with all foreign entry requirements and that your travel documents, including passports and visas, are in order.

  2. 14.2

    For applicable passport and visa requirements, you should consult the relevant embassy or consulate for information. These requirements may change at any time, and it is your responsibility to verify up-to-date information prior to making a reservation and prior to departure. Yaje accepts no responsibility for any person who is refused entry to a flight or any country, including countries through which such person may just be passing on their way to their destination.

  3. 14.3

    As visa and health requirements are subject to change without notice, Yaje recommends that you check health and visa requirements with the appropriate consulate prior to departure. It is also your responsibility to consult your physician for current immunization recommendations before traveling abroad and to ensure that you meet all health entry requirements and follow all medical guidelines related to your trip.

  4. 14.4

    Yaje strongly recommends that you purchase a comprehensive travel insurance policy prior to departure to protect your Product purchase. If you cancel your trip or significantly change your travel dates, your travel insurance policy may refund the cost of cancellation fees and related expenses. Carefully review your travel insurance policy for related terms and conditions.

  5. 14.5

    While most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risks than others. Yaje encourages customers to investigate and review travel bans, warnings, advertisements and recommendations issued by the Brazilian Government and by the governments of destination countries before booking travel to international destinations. Information about conditions in various countries and the level of risk associated with traveling to specific international destinations can be found at:

  6. 14.5

    YAJE DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO ANY DESTINATION IS ADVISABLE OR WITHOUT RISK, AND YAJE IS NOT RESPONSIBLE FOR DAMAGE OR LOSS THAT MAY RESULT FROM THE TRIP TO SUCH DESTINATIONS.

15. Our Responsibility

  1. 15.1

    PLEASE READ THIS SECTION CAREFULLY. THIS SECTION LIMITS YAJE'S LIABILITY TO YOU FOR QUESTIONS THAT MAY ARISE IN CONNECTION WITH YOUR USE OF THE SERVICES. IF YOU DO NOT UNDERSTAND THE TERMS IN THIS SECTION OR OTHERWISE IN THESE TERMS OF USE, PLEASE CONSULT AN ATTORNEY FOR CLARIFICATION BEFORE ACCESSING OR USING THE SERVICES.

  2. 15.2

    THE INFORMATION, CONTENT, SOFTWARE, PLATFORM AND SERVICES PROVIDED BY YAJE MAY INCLUDE INACCURACIES OR ERRORS, INCLUDING REGARDING BOOKING AVAILABILITY AND PRICE ERRORS. YAJE, ITS PARENTS, SUBSIDIARIES AND CORPORATE AFFILIATES (COLLECTIVELY, THE "YAJE GROUP COMPANIES") DO NOT WARRANT THE ACCURACY OF AND DISCLAIM ALL LIABILITY FOR ANY ERRORS OR OTHER INACCURACIES RELATING TO THE INFORMATION, WITHOUT LIMITATION AND DESCRIPTION OF PRODUCTS , PRICES, AVAILABILITY, PHOTOGRAPHS, FEATURES, INCLUSIONS AND EXCLUSIONS, GENERAL PRODUCT DESCRIPTIONS, REVIEWS AND RATINGS, ETC.). IN ADDITION, YAJE EXPRESSLY RESERVES THE RIGHT TO CORRECT ANY ERRORS IN AVAILABILITY AND PRICES AND/OR BOOKINGS MADE AT AN INCORRECT PRICE.

  3. 15.3

    YAJE GROUP COMPANIES MAKE NO REPRESENTATIONS ABOUT THE SUITABILITY OF THE INFORMATION, CONTENT, SOFTWARE, PLATFORM, PRODUCTS AND OTHER SERVICES FOR ANY PURPOSE, AND THE INCLUSION OR OFFERING OF ANY PRODUCTS OR SERVICES DOES NOT CONSTITUTE ANY ENDORSEMENT OF THE SERVICES OR RECOMMENDATIONS YAJE GROUP. ALL SUCH INFORMATION, CONTENT, SOFTWARE, PLATFORM, PRODUCTS AND SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. THE YAJE GROUP COMPANIES DISCLAIM ALL WARRANTIES AND CONDITIONS THAT THE PLATFORM IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. YAJE HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THIS INFORMATION, CONTENT, SOFTWARE, PLATFORM, PRODUCTS AND SERVICES, INCLUDING ALL IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ENFORCEMENT AND NON-ENRIGHTMENT. BY LAW.

  4. 15.4

    SUPPLIERS ARE INDEPENDENTLY CONTRACTED AND NOT AGENTS OR EMPLOYEES OF ANY COMPANY OF THE YAJE GROUP. THE COMPANIES OF THE YAJE GROUP ARE NOT RESPONSIBLE FOR THE ACTS, ERRORS, OMISSIONS, REPRESENTATIONS, WARRANTIES, BREACHES, NEGLIGENCE OR MISCONDUCT OF SUCH SUPPLIERS OR FOR ANY PERSONAL INJURY, DEATH, PROPERTY DAMAGE, OR OTHER CONSEQUENTIAL DAMAGES USE OF A PRODUCT. THE COMPANIES OF THE YAJE GROUP ARE NOT RESPONSIBLE AND WILL NOT MAKE ANY REFUND IN THE EVENT OF ANY DELAY, CANCELLATION, EXCESSIVE BOOKING, ATTACK, FORCE MAJEURE OR OTHER CAUSES BEYOND THEIR DIRECT CONTROL, AND HAVE NO LIABILITY, CANCELLATION, OVERBOOKING, QUALITY ATTACK, FORCE MAJEURE OR OTHER CAUSES BEYOND THEIR DIRECT CONTROL, AND HAVE NO LIABILITY FOR ANY ADDITIONAL EXPENSES, DELAY, LIABILITY, OMISSION, ROUTES OR ACTS OF ANY GOVERNMENT OR AUTHORITY.

  5. 15.5

    IN NO EVENT SHALL THE COMPANIES OF THE YAJE GROUP (OR ANY OF THEIR DIRECTORS, DIRECTORS AND AFFILIATES) BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL, CONSEQUENTIAL OR CONSEQUENTIAL DAMAGES INFORMATION COURSE PURCHASE OF REPLACEMENT GOODS OR SERVICES ARISING OUT OF OR IN ANY WAY RELATED TO A PRODUCT OR RESERVATION, OR YOUR ACCESS TO, DISPLAY OR USE OF THE SERVICES, WHETHER BASED ON A THEORY OF NEGLIGENCE, CONTRACT, TORT, LIABILITY STRICTLY, OR OTHERWISE, EVEN IF YAJE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  6. 15.6

    Se qualquer Empresa do Grupo Yaje for considerada responsável por qualquer perda ou dano que surja ou esteja de alguma forma relacionado com o uso dos Serviços ou com uma Reserva ou uso de um Produto, então as responsabilidades das Empresas do Grupo Yaje não podem exceder o total, o maior entre:

    1. The amount paid to Yaje in respect of the Reserve giving rise to the claim; or
    2. One thousand reais (R$1,000.00).
  7. 15.6

    The limitation of liability set forth in this Section 78 reflects the allocation of risk between the parties. The limitations specified in this Section will survive and apply even if any limited remedy specified in these Terms of Use fails to fulfill its essential purpose. The limitations of liability provided in these Terms of Use will inure to the benefit of the Yaje Group Companies.

16. Your Responsability

  1. 16.1

    You agree to defend and indemnify YAJE and the Yaje Group Companies and all their respective directors, directors, employees and agents from and against any claims, causes of action, demands, lawsuits, lawsuits, investigations, losses, damages, fines, penalties, fees, expenses, costs and any other liabilities of any kind or nature, including but not limited to reasonable legal and accounting fees arising out of or relating to:

    1. Your violation of these Terms of Use or the documents referenced herein;
    2. your violation of any law, rule, regulation or directive;
    3. Your violation, infringement or misappropriation of the rights of third parties, including, without limitation, any rights of publicity or privacy;
    4. Your use of the Services (including the Site);
    5. Your reservation or use of any product; or
    6. Your negligence or willful misconduct.

17. Yaje Tickets

  1. 17.1

    You will receive a YAJE branded ticket (or alternatively a voucher from the Supplier, in each case a “Ticket”) for each Product you book, such Ticket being issued in the name of the applicable Supplier. To access and print your ticket, you will be directed to a secure web page hosted by YAJE that contains a link to your ticket. All bookings will result in you receiving an e-ticket.

  2. 17.2

    You must provide the original and authentic Ticket to the applicable Vendor to redeem your Product. Your reservation cannot be honored or redeemed without presenting a valid ticket. Be sure to read the terms and conditions relating to your booking in order to understand what will be required by the supplier upon presentation of the ticket.

  3. 17.3

    For security reasons, when redeeming your ticket you must present a valid photo ID and sign the ticket.

  4. 17.4

    In some cases, a Supplier may also require you to present the payment card used to purchase your Product at the time of redemption. This normally applies to tickets to attractions and shows. 18. Partners Program

  1. 18.1
    Program Rules

    Partners (service providers) can register in the "Partner Program" of the Platform, enabling them to carry out the sale of their products (such as tours, tours, tickets, training and online tours), here referred to as "Experience".

  2. 18.2
    Terms and Payment Method

    The amounts will be available to PARTNERS within 31 days after the delivery and/or delivery of the service or product offered, given that the PARTNERS must request payment through their Platform profile.

  3. 18.3
    Commission

    The Platform will add, as a commission, up to 22% (twenty two percent) to the value of each experience as a service. The amount is deducted from the amount to be transferred by the Platform to the partner, and enrollment in the Partner Program is free.

    1. The PARTNER can check the available balance regarding the Partner Program through the finances, available in their profile on the Platform.
    2. The PARTNER will receive it via bank transfer, and it is expressly allowed to change this format at the sole discretion of the registered partner.
  4. 18.4
    No-show

    If the USER does not attend the delivery of the service and/or product offered by the PARTNER in the Partner Program, the PARTNER must immediately contact the Platform's commercial team through the service channels, which are online chat or email suporte@yaje.com.br.

19. General Provisions

  1. 19.1

    You agree that no joint venture, agency, partnership or employment relationship exists between you and any of the Yaje Group Companies as a result of these Terms of Use or use of the Services.

  2. 19.2

    Yaje's performance of these Terms of Use is subject to existing laws and legal process, and nothing contained in these Terms of Use limits Yaje's right to comply with law enforcement or other governmental or legal requests or requirements relating to the use of the Services or information provided or collected by Yaje in connection with such use. To the extent permitted by applicable law, you agree to bring any claim or action arising out of or relating to your access to or use of the Services within two (2) years from the date such claim or action arose or occurred or such. claim or cause of action will be irrevocably waived.

  3. 19.3

    If any part of these Terms of Use is determined to be invalid or unenforceable under applicable law, including but not limited to the warranty disclaimers and limitations of liability set forth above, then the invalid or unenforceable clause will be deemed superseded by a valid clause, the enforceable clause that most closely matches the intent of the original clause and the remaining clauses of these Terms of Use will continue in effect.

  4. 19.4

    These Terms of Use (and any other terms and conditions referenced herein) constitute the entire agreement between you and Yaje with respect to the Services and supersede all prior or contemporary communications and proposals, whether electronic, oral or written, between you and Yaje with regarding the Services. A printed version of these Terms of Use and any notice provided in electronic form will be admissible in legal or administrative proceedings based on or related to these Terms of Use to the same extent and subject to the same conditions as other business documents and records originally generated and maintained on printed format.

  5. 19.5

    Any rights not expressly granted herein are reserved.

  6. 19.6

    Acting. YAJE is a Marketplace Platform that mediates business between travelers (USERS) and local tourism service providers. Providers may charge a previously specified amount to accompany USERS on tours through their respective cities, through the Platform.

  7. 19.7

    Subjects. Only USERS and PARTNERS over 18 (eighteen) years of age may register with YAJE.

  8. 19.8

    BRAZIL: Personal data of children and adolescents under 18 years of age must receive different treatment, in accordance with article 14 of the LGPD.

  9. 19.9

    UNITED STATES OF AMERICA: Personal data of minors under the age of 16 cannot be transacted in accordance with CCPA Section 1798.120.

  10. 19.10

    EUROPEAN UNION: the processing of personal data of minors under 16 years of age depends on the consent of the legal guardians, in accordance with article 8 of the General Data Protection Regulation.
